Sales Agreement and Health Guarantee
1. As herein referenced, the parties to this agreement are identified as follows:

SELLER:________________________________  BUYER:___________________________________

 2. This Sales Agreement is acknowledged and affirmed as being a complete description of the terms and conditions of sale concerning the following puppy/dog and purchase price:

PUPPY/DOG: Breed, color, etc._________________________________  PRICE: _________

3. SELLER guarantees, for a period of ONE (1) year from date of purchase, that the puppy/dog herien referenced is free from life threatening genetic defects requiring euthanasia.  All genetic defects must be substantiated by a licensed veterinarian and confirmed by a veterinarian approved by the SELLER.  If it is determined that the puppy/dog has a life threatening genectic defect, the SELLER will replace the puppy/dog with a puppy/dog of the same breed once the defective dog is returned from the BUYER to the SELLER. NO REFUND will be given by SELLER to BUYER. If it is determined that the puppy/dog herein referred requires euthanasia, it must be performed by a veterinarain of the SELLER'S choosing. NO replacement will be provided from the SELLER to the BUYER if the dog is euthanized without written permission from the SELLER.

4. SELLER warrants that at the time of delivery, the puppy/dog herein referenced is in good health. BUYER is encouraged to have the puppy/dog examined be a licensed veterinarian or BUYER choice with seventy-two (72) hours from time of delivery to verify the health of the puppy/dog. If during this 72 hour period, the puppy/dog is found to have a LIFE THREATENING CONDITION as documented by the examining veterinarian then upon verification of this condition AND upon return of the puppy/dog by BUYER, SELLER agrees to supply BUYER with another puppy/dog of the same breed. ALL veterinarian fees or associated costs are to be paid by the BUYER.

5. In the event BUYER fails to have the puppy/dog herein referenced examined by a licensed veterinarian with seventy-two (72) hours after delivery then BUYER understands and agrees that the sale is one of " AS IS " condition.

6. NO guarantee is offered as to adult size, color, hair texture, conformation, dropping of testicles, or the suitability of breeding.

7. NO gurantee is offered against hypoglycemia, cherry eye, eye entroplon/ectropian, heart murmurs, loose knees or hips, dentition, (over or under bite) or hernias. NO guarantee is offered against communicable diseases such fleas, worms, coccidia, hot spots, giardia, dermatitis, or ear mites due to their possible recurring nature. This guarantee is extended to the ORIGINAL BUYER ONLY. The SELLER is not responsible for issues such as landlords, allergies, incompatibilities with other pets or family members, etc. This sale is FINAL and deposits are NON-REFUNDABLE.

8. This Agreement has been read and understood by both parties hereto and by executing the Agreement the parties agree that all terms and conditions contained herein are acceptable and binding.  Regardless of the conditions and circumstances surrounding the negotiation of this Sales Agreement, BUYER and SELLER agree that the interpretation and enforcement of the Agreement shall be governed by the law and state of Tennessee.
